These terms and conditions ("Terms") are a legally binding agreement between Fyre Search Private Limited ("Fyre Search," "we," "our," or "us") and the restaurant partner ("Partner," "you," or "your") participating in the Crowd Puller feature offer program ("Program"). These Terms are designed to protect the interests and experience of customers while providing clear guidelines for Partners. By participating in the Program, you acknowledge and agree to comply with these Terms:

1. Program Activation and Offer Selection

1.1. Partners can activate the Crowd Puller Program by selecting a pre-existing offer program provided by Fyre Search.

1.2. Partners must adhere to the specific terms and conditions associated with the selected offer program, as provided by Fyre Search.

2. Customer Notifications

2.1. Upon activating the Offer Program, Fyre Search's AI-Based Crowd Puller feature will send push notifications to Status TAG Wire users who are considered potential customers based on their preferences and behavior within the platform.

2.2. Push notifications will inform potential customers about the selected offer program and its details.

3. Customer Experience

3.1. Partners must ensure that the selected offer program provides a genuine and valuable benefit to customers. Misleading or deceptive offers are strictly prohibited.

3.2. The quality of products and services offered under the Program must meet the standard of excellence expected by Fyre Search and Status TAG Wire’s users.

3.3. Partners shall not discriminate against any customer based on race, religion, gender, sexual orientation, disability, or any other protected characteristic.

3.4. Partners are encouraged to actively seek and respond to customer feedback, both positive and negative.

3.5. Partners should maintain the review system within the app for collecting and addressing customer reviews, aiming to continuously improve the quality of their products and services.

3.6. Partners must provide chosen offer as a flat discount on the total bill without any capping price or other terms.

3.7. Partners should strive to provide prompt and efficient service to customers availing the offer program.

3.8. Delays or prolonged waiting times should be minimized to enhance the overall customer experience.

3.9. Partners must maintain the quality of their products and services at all times, consistent with the expectations set by Fyre Search and Status TAG Wire’s users.

3.10. Partners must honor the terms and conditions of the selected offer program during its validity period.

3.11. Offers must be made available to customers in a transparent and straightforward manner, and redemption processes must be clearly communicated.

3.12. Partners are obligated to fulfill the terms of the selected offer program during its entire validity period.

3.13. Partners shall not deny or refuse to provide the specified offer to customers who are eligible and present valid coupon codes via notifications during the offer's validity period.

3.14. Partners have the option to switch to a different Crowd Puller offer program as per their convenience.

3.15. In the event of switching offer programs, Partners must adhere to the terms and conditions of the newly selected offer program, including its validation period and any specific requirements.

3.16. Partners are responsible for handling customer disputes or requests for refunds related to the offer program in a fair and timely manner.

3.17. Partners shall extend the Offers to Customers on all days and at all times during the operational hours of the Restaurant.

3.18. Partners hereby permits Fyre Search to advertise and extend the Offers to the Customer on behalf of them.

3.19. The Crowd Puller Offers cannot be combined with any other offers or discounts or deals, or combos extended by Fyre Search or any other third party.

3.20. Notwithstanding anything otherwise set out herein, Partners shall, at all times, remain solely liable for (a) the goods and/or services rendered to a Customer at the Restaurant; (b) any in-person interactions with the Customer by Partners and or its representatives; (c) payment of all applicable taxes and statutory dues with respect to the goods and services offered and charged by Partners at the Restaurant to the Customer and compliance with all applicable laws; (d) the Customer’s experience at the Restaurant; and/or (e) in the event Partners or its representative do not honor the Offers which a Customer desires to avail. Fyre Search reserves the right to contact the Customer via email and/or SMS or by any other means of communication regarding the Customer’s experience, and such response of the Customer shall be communicated by Fyre Search to Partners.

4. Customer Data and Privacy

4.1. Partners must respect customer privacy and comply with all applicable data protection laws and regulations.

4.2. Partners shall not use customer data obtained through the Program for any purpose other than the execution of the Program.

4.3. Partners represents, warrants, and covenants that it will not resell, broker or otherwise disclose any Customer Data to any third party, in whole or in part, for any purpose whatsoever.

4.4. Partners agrees that it will not copy or otherwise reproduce any Customer Data other than for the purpose of fulfilling its obligations under these Terms. Partners (and any other persons to whom the Partner provides any Customer Data) will implement and comply with reasonable security measures in protecting, handling, and securing the Customer Data. If any Customer Data is collected by the Partners (or otherwise on its behalf), the Partner shall ensure that it (and any applicable third parties) adopt, post, and process the Customer Data in conformity with an appropriate and customary privacy policy.

5. Program Modification and Termination

5.1. Fyre Search reserves the right to modify or terminate the Program, in whole or in part, at its sole discretion, with reasonable notice to Partners.

5.2. Partners may terminate their participation in the Program with reasonable notice to Fyre Search only after the validation period of the offer program is over.

6. Compliance and Reporting

6.1. Partners are responsible for complying with all relevant laws and regulations, including but not limited to food safety, health, and sanitation standards.

6.2. Partners must promptly report any issues, complaints, or concerns from customers related to the Program to Fyre Search.

7. Review and Audit

7.1. Fyre Search reserves the right to periodically review Partner compliance with these Terms and the quality of their participation in the Program.

7.2. Non-compliance with these Terms may result in the suspension or termination of the Partner's participation in the Program.

8. Liability

8.1. Fyre Search shall not be liable for any losses or damages incurred by Partners arising from their participation in the Program, except as expressly provided in these Terms or required by law.

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of New Delhi, India.

By participating in the Crowd Puller Program, Partners acknowledge that they have read, understood, and agreed to these Terms and are bound by their provisions. Fyre Search reserves the right to update these Terms at any time, and such updates will be communicated to Partners. Failure to comply with these Terms may result in the suspension or termination of the Partner's access to the Program.
